NOTICE OF PUBLIC HEARING
Pursuant to chapter 91, Hawaii Revised Statutes, notice is hereby given that the Department of Land and Natural Resources, State of Hawaii, will hold public hearings [as scheduled below*] for the Counties of Hawaii, Maui, Kauai, and Oahu to consider the proposed amendments to the Hawaii Administrative Rules, Chapters: 13-234-3, 13-234-4, 13-234-5, 13-234-25, and 13-234-34 as they relate to fee increases for recreational mooring rates at state boating facilities, offshore moorings rates, mooring without permission, commercial fees for vessels at state boating facilities, and annual user fees for state boating ramps.

This is the third round of hearings on these proposed rules as the fee schedule was significantly reduced after the October 5, 2002 hearings. The rules, as now proposed, will increase recreational mooring fees an average of 25% to 40% depending on the specific harbor, in the first year that the new rules take effect. Conditioned upon legislative authorization for two new $10 million CIP authorizations using reimbursable bonds for state boating facility improvements, all state boating facilities will have additional across the board mooring fee increases of 8% each for each of the years.

The Division of Boating and Ocean Recreation also proposed increasing the commercial permittee's fees from two percent of gross receipts to three percent (Act 126 of the 2005 Legislative session has preempted this action). The full proposed rule change will proceed to public hearing to assure that there is compatibility with existing rules.

All interested parties are invited to attend and to present their views on the proposed amendments, either orally or in writing. Written statements may be submitted at the public hearing or to the Chairperson's Office at any time prior to December 30, 2005.
